Randy Long and Austin Jackson obtained summary judgment in defense of a six-figure fire loss claim in Oklahoma state court. The landlord’s property insurer sued a commercial tenant for negligently causing a fire that burned the landlord’s leased warehouse. Mr. Long and Mr. Jackson filed a summary judgment motion based upon an anti-subrogation rule that protects tenants. The insurer argued that the lease provided exceptions to the rule, but Mr. Jackson convinced the judge that the tenant was immune from liability.
