Randall Long and Austin Jackson obtained summary judgment in favor of a commercial tenant in a fire loss suit filed by the landlord’s fire insurer. The suit alleged the tenant negligently caused the fire, which destroyed a warehouse used to store and distribute liquor. In defense, Messrs. Long and Jackson argued that the subrogation suit was barred by an anti-subrogation rule developed in the Oklahoma courts in the 1970s.  The trial court agreed and granted judgment in the tenant’s favor.
