An employee of a small town store alleged he was seriously injured when a heavy piece of equipment fell while he was unloading the defendant’s semi-trailer. Plaintiff later had four spinal surgeries. The plaintiff alleged the commercial trucking defendant improperly loaded the trailer. At trial, Bill McKee focused the jury on the plaintiff’s own actions and failures. The plaintiff requested $3,000,000.00 in damages, but the jury found the plaintiff held most of the blame, and returned a defense verdict. Lauren Marciano successfully defended the verdict on appeal. Two-and-a-half years later, the appellate court dismissed the appeal, leaving the defense verdict intact.
