Summary Judgment for Home Inspector on Claims Arising from Residential Inspection

In Oklahoma County District Court, Joe Stall sought summary judgment on claims by a homeowner that a home inspector had failed to identify water intrusion and mold. The homeowner sought damages in excess of $150,000 for breach of contract, fraud and negligence, as well as damages for personal injury. Joe briefed and then presented in court a compelling defense that the plaintiff could not state valid claims under Oklahoma law. Judgment was entered for the home inspector and the case dismissed. Obtaining summary judgments in Oklahoma's state district courts can be challenging, but that's something we're able to to do given our extensive trial court experience.
