Summary Judgment in Favor of Horizontal Well Owner-Operators
A vertical oil well owner sued two owners-operators of a horizontal well for a “frac hit” that allegedly damaged the plaintiff’s vertical well. Kerry Lewis and Lindsey Albers obtained summary judgment in favor of the horizontal well owner-operators because they did not own the well when the frac hit took place and could not be held liable under the Oklahoma Fraudulent Transfer Act because they had paid valuable consideration for the horizontal well.
