A family in rural Oklahoma alleged that their home furnace was negligently maintained by an HVAC service company, resulting in carbon monoxide levels more than 1,000 times greater than is considered safe. Plaintiffs’ counsel followed the “Reptile” strategy popularized by Don Keenan and David Ball. Claims for medical expenses and lost wages exceeded $1 million with traumatic brain injury the centerpiece. Nathan Clark and Rachel Rogers discredited Plaintiffs’ theory of causation and had Plaintiffs’ expert witness testimony on damages largely excluded under Daubert. A five-day trial led to a unanimous jury verdict for the defense.
